Making a Contract with us
An order can be placed with us through our website, by telephone or by visiting our premises.
When you place an order with us you are making an offer to buy goods and payment is requested at that stage to enable the order to be processed.
When we receive your order with payment through our website, we will send you an Order Confirmation which confirms acceptance of your order. At that stage, a contract has been made between us.
The Order Confirmation is given a unique number and provides details of shipping and billing addresses together with a description of the goods purchased, delivery charges and the total price inclusive of VAT.
Our receipted VAT Invoice and a copy of our Terms & Conditions will follow by email on the same day.
Our VAT Invoice will be given the same number as your Order Confirmation and will also provide the date of the transaction, our VAT registration number, the price exclusive of VAT, delivery charges, the VAT amount, and the total price inclusive of VAT.
During the ordering process, your attention is drawn to our Terms and Conditions which are readily accessible on our website. You can also request a quote from us on our website prior to placing an order. The language used on our website is English and once you have chosen the goods you wish to order, you will be asked to “Add to Cart” where you can calculate shipping costs. When your shopping is complete, you click “Proceed to Checkout” which takes you to our secure checkout by following the guided steps. You can edit or remove items or modify to change options in your Cart by clicking the relevant buttons and at all stages of the process our telephone number is clearly displayed if you require assistance.
For orders received by telephone or by visiting our premises, verbal acceptance will be provided on payment and our receipted VAT Invoice and a copy of our Terms & Conditions will follow by post once the order is processed which is normally on the same day.
Customers making enquiries by telephone may also request a quote and a copy of our Terms & Conditions prior to placing an order.
Payment
We use secure payment methods and payment can be made by cheque or debit or credit card. Online customers have the option to pay by card through Paypal or ClearAccept. We take all reasonable precautions to keep your payment secure but unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you. Payment details are shredded daily and we are monitored by an online data security company called Trustwave who issue an annual Certificate of Compliance once they are satisfied that we have conformed to their strict regulations for online security.
Customers may request a credit account and, subject to acceptance, will be granted 30 days credit from date of invoice. Payment on delivery of commercial structures will be accepted by prior arrangement only. Any customer who fails to pay for goods supplied within an agreed period will be liable for all costs incurred by us including collection costs, legal costs and interest on the goods supplied.
Delivery
We have a fixed delivery charge for deliveries of garden polytunnels, fruit cages, raised beds and polytunnel accessories to UK mainland addresses. For all non-mainland addresses, we can deliver to a nominated mainland address and the customer will have to arrange onward carriage at their own cost.
Non-mainland addresses include the Isle of Skye.
Depending on location, there may be a charge for delivery of commercial polytunnels , delivery will be to the nearest point of access.
Our supplier of greenhouses, Elite Greenhouses, arranges delivery to customers. However, Elite do not deliver North of Inverness or to certain rural postcodes. If this is the case, please contact us for a delivery price or you can arrange to have the greenhouse delivered to our Nairn premises and arrange for the onward carriage at your own cost.
Despatch normally takes between 1 to 3 working days for polytunnels. Delivery of commercial structures can take 7-14 working days from the date of order. However, depending on your location and the time of year, delivery of commercial structures can change.
When ordering a greenhouse, you will be advised of the delivery date as delivery depends on the specification of the structure as well as your location and the time of year.
Non-standard or made to measure items may require additional manufacturing processes and a specific delivery period will be given in this instance.
Reasonable access for heavy goods vehicle must be available for unloading the goods. If special arrangements have to be made due to inadequate access, we must be informed in advance and we reserve the right to charge additional carriage or associated costs.
If the goods are lost or damaged in transit, please let us know as soon as possible.
Your Right to Cancel
Under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel the contract at any time up to the end of 14 working days after you receive the goods. A working day is any day other than weekends and bank or other public holidays.
To exercise your right of cancellation, you must give written notice to us. You can do this by sending notice to us by email.
If you exercise your right of cancellation after the goods have been delivered to you, please note that you will be responsible for returning the goods to us as soon as possible and at your own cost. The goods must be in their original packaging and in their original condition. Please also note that although we charge a fixed delivery cost you may have to pay a carrier a significantly higher amount to return the goods.
If you fail to return the goods to the senders address as required, we will charge you the direct costs of collection and if you fail to take reasonable care of the goods before they are returned to us, and this results in damage or deterioration, we will charge you for the reduction in value.
Once we receive notification that you are cancelling the contract, we will refund or credit you within 14 days after the day we receive back from you the goods supplied, any sum that has been paid by you or debited from your credit card for the goods.
This policy does not apply to non-standard goods which have been manufactured to your specification and if this is the case you have no cancellation rights.
This cancellation policy does not affect your legal rights if, for example, goods are faulty or mis-described.
The foregoing cancellation rights only apply to consumer contracts and do not apply to business contracts.
Guarantees/Complaints
Any claim by you that the goods are defective or fail to correspond with their description should be notified to us as soon as possible and, in order for us to provide the best service to you, it would be helpful to contact us within 14 days of delivery or, where the defect was not apparent on reasonable inspection, within 14 days of discovery of the defect.
Upon receipt of your claim, we will arrange for inspection of the faulty goods and will either repair, replace the goods or refund the total invoice price.
Highland Polytunnels offers limited guarantees in relation to the products it supplies, which vary in length depending on the product in question, and such guarantees are stated below. During the guarantee period, Highland Polytunnels warrants that the relevant Goods will be free from material defects in quality and workmanship, and that they will correspond to their specification. No guarantee for wind or snow loading is provided unless otherwise stated.
We will not be liable for any defect in the goods arising from fair wear and tear, wilful damage, accident, or any alteration or repair carried out without our approval.
We offer no guarantees in respect of goods which are manufactured by third parties but wherever possible we will pass the benefit of any warranty or guarantee from the manufacturer to you.
Information on manufacturer’s guarantees is available on request.
Data Protection and Privacy
We recognise our responsibility to protect the data that you entrust with us and take security issues very seriously and use software to protect automated programs from collecting information about you. We also use an information security company which provides on demand data security.
When you register and use our website, you will be asked to provide certain information such as your contact details and this will be securely stored on our server. It is our policy not to pass on your details to any other organisation and we will not continually contact or pester you.
Documentation created as a result of telephone or personal visit to our premises together with all our business records are stored securely on our premises.
In order that we can monitor and improve our website, we may gather certain information about you when you purchase goods, including details of your IP address.
New technologies are emerging on the Internet that help us to deliver customised visitor experiences. In particular, there is a technology called “cookies” which may be used by us to provide you with customised information from our website. A cookie is an element of data that a website can send to your browser which may then store it on your system. Cookies allow us to understand who has seen which pages and advertisements, to determine how frequently particular pages are visited and to determine the most popular areas of our website. Cookies also allow us to make our website more user friendly by, for example, allowing us to save your password so that you do not have to re-enter it every time you visit our website. We use cookies so that we can give you a better experience when you return to our website. Most web browsers automatically accept cookies. You do not have to accept cookies, and you should read the information that came with your browser software to see how you can set up your browser to notify you when you receive a cookie and this will give you the opportunity to decide whether to accept it.
Although we take all reasonable steps to protect your personal information, we cannot guarantee the security of any data you disclose online. We will therefore not be responsible for any breach of security unless this is due to our negligence.
You have the right to see personal data as defined in the Data Protection Act that we keep about you, upon receipt of a written request and payment of a fee. If you want to be removed from our mailing list or have us delete your details from our database, please send an email to us detailing your request.
General
The contract shall be governed by the laws of Scotland.
We do not guarantee that our website will be compatible with your PC and we accept no liability for any corruption or loss of data held on your PC, or any liability for any other loss or damage of any kind caused to your PC resulting from use of our website.
Owing to our policy of continuous improvement, we reserve the right to alter any specification or price without prior notice.
The fact that our Terms & Conditions are displayed electronically or transmitted via the Internet shall not affect their validity or enforceability.
The foregoing Terms & Conditions apply to new contracts from September 2014. We may update our Terms & Conditions at any time so please do not assume that the same Terms & Conditions apply to your future orders. In the event of our Terms & Conditions being updated in the future, we will provide a link on our website to ensure that you are able to access previous versions of our Terms & Conditions.
It is our responsibility to supply you with goods that meet your consumer rights. If you have any concerns that we have not met our legal obligations, please contact us.
